The Chief Justice, John Roberts, ordered allotment of the circuit court on November 20, 2020. The order is,

“It is ordered that the following allotment be made of The Chief Justice and the Associate Justices of this Court among the circuits, pursuant to Title 28, United States Code, Section 42 and that such allotment be entered of record, effective November 20, 2020.

Analysis:

Justice Samuel A. Alito, Jr.: charging Pennsylvania

Justice John G. Roberts, Jr.: charging North Carolina, and Virginia

Justice Brett M. Kavanaugh: charging Michigan and Minnesota

Justice Amy Coney Barrett: charging Wisconsin

Justice Elena Kagan: charging Arizona, California, and Nevada

Justice Neil M. Gorsuch: charging New Mexico

Justice Clarence Thomas: charging Florida and Georgia

All swing states (Pennsylvania, Michigan, Wisconsin, Florida, and Georgia) have been assigned to conservative justices. Only Arizona and Nevada have been assigned to Elena Kagan, liberal justice. Even some key states, such as New Mexico, Virginia, Minnesota, and North Carolina, have been allocated to the conservative justices. Three (Gorsuch, Kavanaugh, and Barrett) out nine justices were nominated by President Donald J. Trump.
