A Coup d’etat – The 2020 U.S. Presidential Race -7: Protecting Constitution

When Lin Wood, an attorney for Trump Team, was interviewed by Newsmax TV, a strange thing was occurred during his interview. As he mentioned that George Soros and the CCP were behind of the 2020 U.S. presidential election fraud, Attorney Lin Wood’s talk was cut off. But Newsmax TV made its statement by saying “TV did not interrupt the interview.” Later, Lin Wood tweeted (@LLinWood), “I am receiving more than the normal number of profane emails, insults, & death threats in the last couple of days. Have I said something that has upset any group of people??? Since these are unique times in our country, I have had to put my personal security guards on high alert!” (November 18, 2020) This symbolized current sentiment in the American society.

After long recount and lawsuits, some states may still reject the decision. If the Supreme Court declared “illegal” of the 2020 presidential election in some of key battleground states (e.g., MI, PA, GA, NV, AZ, and WI), the verdict of Supreme Court might not be carried out. What is next for President Trump? Based on the constitution, President Trump can carry out at least two options in the future.

A. Alien and Sedition Acts of 1799

*Aim of the Law

The Alien and Sedition Acts signed into law by President John Adams in 1798. The Act allowed the president to imprison or deport aliens considered “dangerous to the peace and safety of the United States” at any time. In other words, this law was meant to guard against the threat of anarchy.

*The Invocation by the President

December 7, 1941: President Franklin Roosevelt invoked the ACT in responding to the bombing of Pearl harbor by the Japanese imperial forces.

September 8, 1945: President Harry Truman issued Presidential Proclamation 2662, titled removal of Alien Enemies.

June 26, 2018: The U.S. Supreme Court (5-4 decision Trump v. Hawaii) upheld Presidential Donald Trump declared Proclamation 9645, prohibiting Muslims entering the United States (i.e., Trump’s travel ban).

B. Insurrection Act of 1807

*Aim of the Law

A United States federal law empowers the President to deploy U.S. military and National Guard troops within the United States in particular circumstances, such as to suppress unrest, insurrection, and rebellion. The 1807 Act has been modified twice: in 1861 and in 1871, and many presidents have invoked the Insurrection Act throughout American history.

*The Invocation by the President

September 30, 1962: President John F. Kennedy invoked the Act in responding to the enrollment of James Meredith, at the University of Mississippi. The well-known Ole Miss riot or Battle of Oxford.

April 5, 1969: President Lyndon Johnson issued Presidential Proclamation due to Washington, D.C. riots after Dr. Martin Luther King Jr. was assassinated.

May 1, 1992: President George H.W. Bush invoked the Act in responding Los Angeles riots after the Rodney King Incident.
